1. ABOUT THESE TERMS

These Terms and Conditions (“Terms”) govern the use of Mere (the “Website”) and the purchase of products listed on the platform www.bymere.com.

Mere is an online e-boutique that connects customers with independent artists from around the world. Mere does not sell products itself; instead, it acts as a broker facilitating transactions between artists (“Sellers”) and customers (“Buyers”). The purchase agreement is directly between the Buyer and the Seller.

By placing an order through Mere, you acknowledge and agree to these Terms. 

2. ROLE OF MERE (GUILDED GOODS)
  • Brokerage Service: Mere does not own or manufacture any of the products listed on the platform. Mere acts as an intermediary, facilitating sales between Buyers and independent Sellers.
  • Payment Handling: Buyers make payments to Mere, which then forwards the product price to the Seller, minus the agreed commission.
  • No Direct Seller Liability: The responsibility for product quality, descriptions, and authenticity lies with the Seller.
3. ORDERING & PAYMENT

3.1 Placing an Order

When placing an order, Buyer will receive an order confirmation email summarizing the items purchased. This does not mean the order has been accepted yet.

3.2 Order

Confirmation & Contract Formation

  • Once payment has been processed and the Seller confirms product availability, the Buyer will receive a dispatch confirmation email. At this point, a contract is formed directly between the Buyer and the Seller.
  • If an order cannot be fulfilled, Mere will notify the Buyer, and the Buyer will not be charged.

3.3 Payment Processing

  • Payments are processed via Mere, acting an an authorized payment collector for the Seller.
  • The Buyer's payment obligation is fulfilled once Mere has successfully collected the funds. 

3.4 Taxes, Import Duties & Customs Fees

  • All applicable tax, import duties, and customs fees are the Buyer's responsibility.
  • Mere and the Seller do not cover customs duties, VAT, or any other import-related charges. If such charges apply, they must be paid before receiving the products.

4. SHIPPING & DELIVERY

4.1 Shipping Responsibility

  • Mere coordinates shipping on behalf of the Seller.
  • Shipping timelines vary depending on the Seller's location and the destination country.

4.2 Risk of Loss

  • Once an order has been dispatched, the risk of loss or damage passes to the Buyer. The Buyer then becomes responsible for the property and assumes all risks, including but not limited to loss, theft, damage or deterioration.
  • If an order is lost or damaged during transit, please contact us and we will work with the Seller to find a resolution. 
5. CANCELLATIONS & RETURNS 

5.1 Cancellation Policy

  • Orders cannot be canceled once plated, as all products are bespoke, custom-made, made-to-order, and handcrafted specifically to each order.
  • Once an order is confirmed, it goes into production, and the Buyer is fully responsible for the purchase.

5.2 No Returns or Refunds

  • All products sold on Mere are bespoke, custom-made, made-to-order, and handcrafted specifically to each order. Therefore, returns and refunds are not accepted, except in cases of defects or incorrect items.

5.3 Faulty or Incorrect Products

If you receive a defective or incorrect product:

  1. Report the issue within 7 days of delivery via our contact form.
  2. Provide photos of the defect or incorrect item.
  3. The Seller will review the claim and, if valid, offer a replacement, repair, or refund.
6. TAX RESPONSIBILITIES

6.1 Seller’s Tax Obligations

  • Each Seller is responsible for complying with all tax obligations in their respective country.
  • Mere does not withhold or collect VAT, sales tax, or any other local taxes on behalf of the Sellers.
  • Each Seller must determine and remit any applicable taxes related to the sale of their products.

6.2 Buyer’s Tax Obligations

  • The buyer is responsible for paying any applicable import duties, VAT, or local sales taxes imposed by their country. Mere and the Seller are not responsible for these additional charges. Failure to pay these charges may result in delays or refusal of package delivery by customs authorities.

7. LIMITATION OF LIABILITY
  • Mere is not responsible for product defects, misrepresentations, or non-fulfillment by the Sellerr.
  • Any dispute regarding product quality or conditions must be resolved between the Buyer and the Seller.
  • Mere is not liable for import duties, VAT, or customs charges.

8. DISPUTE RESOLUTION & APPLICABLE LAW
  • These Terms are governed by the laws of the State of California in the United States of America.
  • Any disputes shall be resolved in the courts of the State of California in the United States of America.
  • Mere encourages Buyers and Sellers to resolve disputes amicably.

9. CHANGES TO THESE TERMS

Mere reserves the right to modify these Terms at any time. Changes will apply to orders placed after the new Terms take effect.
